MEDIATION is a negotiation process moderated by an independent and impartial facilitator, the mediator. Parties to a dispute participate in mediation by mutual consent, and they are encouraged to agree among themselves on a suitable mediator. Under section 26.6.2 of UFA/FA Chapter 26, if the parties cannot agree on a mediator, the Board shall appoint a mediator from the Panel Roster established under section 26.5.3 within 15 days of the dispute being referred to mediation. The mediation process is confidential with the records maintained only by the parties to the dispute unless they agree otherwise. A dispute referred to mediation under sections 26.3 or 26.4 which is not resolved by mediation may be referred to arbitration.
